Driver Terms of Service & Privacy Policy

These Driver Terms of Service ("Terms") govern your access to and use of the OdinRideShare mobile application ("App") as an independent driver partner ("Driver"). By downloading, installing, or using the App, you agree to be bound by these Terms and the OdinRideShare Privacy Policy.

1. DEFINITIONS

"Company" – OdinRideShare Inc., a Delaware corporation, owner and operator of the platform.

"Driver" – An independent contractor who provides passenger transportation services using the App.

"Passenger" – A user requesting transportation through the App.

"App" – The OdinRideShare Driver mobile application, used to receive, accept, and complete ride requests.

"Service" – The technology platform that connects Drivers and Passengers, manages payments, and provides related tools.

2. PURPOSE AND RELATIONSHIP

OdinRideShare provides technology to connect Drivers with Passengers. The Company does not employ Drivers and does not provide transportation services. Drivers act as independent contractors and are solely responsible for complying with all applicable laws, permits, and insurance requirements.

3. DRIVER REQUIREMENTS

To use the App as a Driver, you must:

  • Be at least 21 years old and legally authorized to operate a motor vehicle.
  • Possess a valid driver’s license and vehicle registration.
  • Maintain a clean driving record and comply with all traffic laws.
  • Ensure your vehicle meets local safety, cleanliness, and insurance standards.
  • Pass all background, identity, and driving history checks required by OdinRideShare.

4. ACCOUNT SECURITY & ACCESS

Drivers must provide accurate, complete, and updated personal and vehicle information. You are responsible for safeguarding your account credentials and device access. Sharing your account or using another person’s account is strictly prohibited.

5. DRIVER RESPONSIBILITIES

  • Provide safe, professional, and respectful service to all passengers.
  • Refrain from any form of discrimination or harassment.
  • Ensure your vehicle remains in good working condition and properly insured.
  • Use the App only for lawful ride activities and follow all route and pickup protocols.
  • Report any accidents, incidents, or passenger disputes promptly to OdinRideShare support.

6. EARNINGS & PAYMENTS

Drivers earn fares based on completed trips. Fares depend on time, distance, surge pricing, and other factors. OdinRideShare processes payments securely through third-party payment gateways and transfers Driver earnings after applicable fees, commissions, and taxes. Drivers are responsible for declaring and paying their own taxes.

7. VEHICLE & INSURANCE REQUIREMENTS

Drivers must carry valid personal vehicle insurance as required by law. OdinRideShare does not provide personal injury, property, or vehicle damage insurance coverage for Drivers. You acknowledge that you are solely responsible for maintaining appropriate coverage and documentation.

8. PRIVACY POLICY

OdinRideShare collects personal and trip-related data to manage the platform effectively. Information such as location, trip logs, contact details, and payment data may be shared with Passengers, payment processors, and regulatory authorities when necessary. All data is handled according to the OdinRideShare Privacy Policy.

9. LIABILITY LIMITATION

The Company is not responsible for accidents, damages, traffic violations, or losses incurred during rides. Drivers operate entirely at their own risk. The Company’s liability under any claim shall not exceed USD 100.

10. INDEPENDENT CONTRACTOR STATUS

Drivers acknowledge and agree that they are independent contractors, not employees, agents, or representatives of OdinRideShare. Nothing in these Terms shall be interpreted as creating an employment relationship. Drivers are not entitled to wages, benefits, or reimbursements unless explicitly agreed upon in writing.

11. TERMINATION

The Company may suspend or terminate your access to the Driver App at any time for conduct violating these Terms, unsafe driving, passenger complaints, or fraudulent activity. You may terminate your account at any time by submitting a written request.

12. LEGAL GOVERNANCE & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved through binding arbitration under the American Arbitration Association (AAA) rules. Both parties waive the right to a jury trial or class action participation.

13. UPDATES & MODIFICATIONS

OdinRideShare may revise these Terms at any time. Changes will be communicated via the App or email. Continued use of the App after notification constitutes acceptance of the new Terms.
